In certain cases it may be transferable to a different puppy. (Deposits are to hold the puppy from the public & secure him/her as your new family member. If you change your mind your deposit/holding fee will be forfeited.) See deposit/holding fee agreement. Sending your deposit/holding fee means that you agree to the terms of this document whether signed or not. ______This puppy/dog is being sold as a pet and a family companion and MUST be spayed/neutered prior to 12 months of age (with a recommended age of 6-8 months). By initialing this contract, I fully understand that this dog was not sold for the intention of breeding or to be bred and seller holds no responsibility if buyer does so against seller’s wishes. If AKC papers are desired, please notify seller asap. Puppies need to be registered BY 6 MONTHS OF AGE or a $65 late fee will be required. Seller can register the puppy in her name and buyer can transfer papers after proof of spay/neuter for a nominal fee paid to AKC. Buyer will pay for AKC registration but is not responsible for the late fee or transfer fees if applicable. ______If the puppy described in this document is not neutered/spayed by 12 months & proof is not presented by 18 months (or upon request), legal proceedings may be started for seller to regain possession. If it is discovered that the puppy/dog has not been neutered/spayed according to contract terms, seller has the right to regain possession or pursue a monetary penalty of $1500 in addition to other legal fees/penalties as described in this document at seller’s discretion. Furthermore, for those buyers not keeping in touch by facebook, text or email, if a picture of said dog with buyer (a selfie) is requested by seller & not produced within 24 hours of said request, legal proceedings to verify dog has not been resold may also be started. Seller reserves the right to ask for updates twice a year but welcomes updates more often of course. _______The buyer is aware the Pomeranian is sold with a 1 yr (of age) limited congenital health guarantee. The seller has had the puppy examined by a licensed veterinarian at 8-16 wks of age and was found to have no health problems. The puppy/dog is assumed healthy at the date of sale. There are no guarantees to the final color, testicles descending, size, coat type, ear erection, bite, patelle, temperament, or train ability of the Pomeranian. Seller stands behind her dogs & will make every effort to work with buyer should a question of LIFE THREATENING CONGENITAL health present itself within the first 12 months or age as long as all terms of contract have been followed, including veterinary exam done within 72 hrs (3 business days) of buyer taking possession. The accompanying form must be received by breeder & dated appropriately. Furthermore, feeding a raw diet during the first 12 months voids any liability of the seller. This guarantee does not cover collapsing trachea, patellar luxation, kennel cough, entropian, cherry eye, ear infections etc but only life threatening congenital issues (I.e. a non curable condition the puppy is born with that is expected to shorten their life). Proof of said condition must be presented to the breeder by TWO different unaffiliated vet clinics (not the same owner or franchise) supporting the claim. Second clinic will be of the seller’s choice. _____Buyer agrees to have the dog/puppy examined by a veterinarian of his/her choice within 72 hours after receipt at buyer’s expense. Seller does not guarantee a parasite free puppy as some can be dormant & present with stress. This includes but is not limited to giardia & coccidia, although the puppy has been treated for these before leaving. Seller suggests a fecal exam be done when your puppy comes home. Although the puppy was dewormed, some parasites can be transmitted to humans and it is better to be safe than sorry. If upon examination the veterinarian finds a problem with said Pomeranian the buyer will notify the seller as a courtesy. ______At the time puppy is paid in full, it is assumed buyer is deemed the “owner” of said dog on the date of receipt. In the event buyer changes their mind on purchase of puppy once full payment is made (whether puppy never leaves seller’s care or is returned), a boarding fee of $30/day will be assessed until puppy finds a new home or original purchase price is exhausted. The reason for this is puppy has been reserved for you since the date a deposit was made. Now that he/she is older, it may be harder to place him/her. Refunds in this situation are at the sole discretion of the seller. This fee will also be assessed if puppy is held longer than the agreed upon date once deposit is made. ______Pomeranian is guaranteed for 72 hours from date and time of sale against infectious disease such as Parvo and Distemper as long as terms of the contract have been followed and air travel is not required. Because Parvo is such a HIGHLY contagious disease and the Pomeranian can be exposed to this disease in a public place or even your own property without you knowing, it is extremely important to be cautious where you allow your Pom to go until it is completely vaccinated. Remember your puppy has only had booster shots to this point and will need its last shot at/after 16 weeks of age. A puppy’s little immune system is still weak and developing so think twice about taking him/her to the groomer, dog park, visiting neighbors or family, and pet stores until all vaccinations are given. If transporting your puppy/dog from sellers home a long distance please be advised that it is not recommended to allow your puppy to “potty” until you reach your destination. You don't know what dogs have been on public ground and therefore what diseases or viruses. Once your puppy is fully vaccinated this is less of a concern. (If airline travel is required please see next paragraph) _______In the event travel by air is required to pick up the puppy, the seller will not be held responsible for any accidents, injury or death once the puppy changes hands. Since the airports are a public place, this makes the possibility for viruses to be picked up higher and it is recommended that the puppy have 2 vaccines on board prior to travel. If a date for pick up has been arranged prior to the puppy being 10 wks old, it may not be possible to make this happen due to size of the puppy or other reasons. Therefore, seller cannot be held responsible if puppy were to contract parvo or other forms of disease. It is recommended that you do not remove your puppy from the travel bag during the time you are in the airport to limit exposure. If you must, use puppy pads in the family bathroom rather than the “public dog areas”. If a nanny is being used, her fees are above the price of the puppy and paid directly to her at the time of delivery (in cash) and are determined by her prior to arrangements. She has the right to change the price if additional travel is required but does her best to keep travel arrangements as planned. Once the puppy has been handed off by the seller and is in his/her care, seller is no longer responsible for the puppy. While the nanny is very responsible and takes excellent care of the puppies, seller cannot assume the risk associated with travel. Buyer also understands that the nanny flies standby and her flight is not guaranteed on the arranged date/time and could change. Seller and nanny do their best to keep you informed of any changes if/when they are made. References are available by request and her information is provided when deposit is made. Buyer agrees to allow nanny to transport puppy and does not hold seller or nanny responsible for any accidents, injuries, or death. ______Seller will not be responsible for ANY injuries sustained from accidents, trauma, or neglect incurred after the date of sale. Seller/Buyer hereby state to the best of their knowledge, this Pomeranian is in good health at the time of sale. Seller will not sell a sick puppy or one in question of being ill. _____Buyer agrees to read information included with puppy regarding hypoglycemia, grooming, new puppy tips, feeding routine, and prevention of dental disease. _____Buyer has confirmed with landlord that the puppy/dog is allowed on the premises if renting. _____ Buyer acknowledges that said puppy is microchipped and is registered to the seller. Seller’s info can not be removed. Buyer is listed as alternate contact or co owner & additional contacts can be added by request. It is the buyer’s responsibility to keep personal information up to date & buyer agrees to update seller with new address & phone numbers as appropriate or at least once a year. This helps ensure that no changes of ownership be made without seller’s knowledge. It is not seller’s intention to bring unwanted puppies into the world as too many are euthanized in shelters each year. If a situation arises that a change of ownership must be made, seller has first rights to said dog. This puppy/dog will NOT under ANY circumstances be taken to a shelter or given to a rescue. (This is the ONLY reason I ask for your DL # as it may give me an added piece of info to find you should I be contacted in the event your dog is found. Keeping in mind this could be 10 years down the road.) ______In the event the puppy or dog is picked up (by a shelter, animal control, private party or vet’s office etc), and seller is contacted in connection to the microchip, buyer gives the seller permission to collect the dog on their behalf for ANY reason. Seller will make every effort to return the dog to the buyer within reason. If any fees are paid, buyer will be responsible to reimburse seller upon return of dog. ______If a situation arises that a change of ownership must be made; seller has FIRST RIGHTS to said dog. The buyer MUST offer in writing, to return the puppy to the seller. No funds will be exchanged unless the puppy is re-sold by the seller, and then any net profit (after any necessary expenses, including obedience classes & veterinary treatment) will be given to the original purchaser. If it is decided by the seller that dog was mistreated or neglected/abused no monies will be returned under ANY circumstances. Buyer will be liable to pay a sum of at least two thousand five hundred ($2500) dollars as monetary compensation plus any fees incurred to regain possession of the dog (including attorney, court costs, filing fees, travel, shipping costs, etc) to the seller if puppy is given away, sold, or otherwise transferred or disposed of without offer of first refusal presented to the seller. Seller has the right to hold legal proceedings in her county (Casey County, Kentucky) or one of her choice. If the puppy/dog is reported as deceased, seller has the right to request a report (including microchip number) from a licensed veterinarian to support such claim. If a report cannot be presented, legal proceedings may still be started. It is the buyer's responsibility to transport dog to seller & assume fees unless otherwise agreed to in writing by the seller. ______Seller has the right to prosecute if dog is bred against seller’s wishes, whether on purpose or accidentally, and will reclaim all costs incurred for legal expenses to enforce this contract as well as any profit made from puppy sales. A minimum of five thousand ($5000) dollar monetary compensation plus any fees incurred to prosecute (including attorney, court costs, filing fees, travel, shipping costs, etc) will be sought if dog is bred against seller’s wishes. Other conditions stated in the above paragraph also apply should prosecution be necessary. ______The buyer acknowledges a copy of this contract has been provided. ______The buyer will assume any and all veterinary costs and understands that like children dogs need food, rest, exercise, tender loving care, and they cost money. Reasons like a new baby, moving, disagreement in family, divorce, medical expenses, etc. are not reasons to dispose of your puppy/dog. That being said things do happen, even to the best of us, and your puppy/dog is ALWAYS welcome here no matter what age & no judgments will be made. ______Buyer is aware that toy/small breed dogs are not the same as larger breed dogs and do not always lose their baby teeth. At the time of spay/neuter, have your vet check for retained puppy teeth and have them pulled if present. If this is not done it can lead to problems. Having read the above & 2 preceding pages and with full understanding of the contents herein, by signing below, both parties are bound by this contract agreement. The seller agrees to sell and does hereby sell, and has contracted to the buyer a dog of Pomeranian breed: in sound body and good health, and free from communicable disease and defects as far as appears to the eye at the date of this sale. No refunds will be given unless arrangements have been made and seller agrees that is the appropriate solution. No veterinary bills will be paid by the seller. Further information: Your puppy has been vaccinated and wormed as follows: DHPP , Strongid T , Heartworm Preventative Your puppy has been eating NutriSource Chicken & Rice Puppy food. It is not my recommendation to start your puppy on canned food as that encourages a picky eater and may lead to problems down the road. I do not recommend that your puppy wear a collar while it is in its kennel as I have heard too many stories of dogs beings strangled this way. I do recommend that it wears a collar or harness with an identification tag any other time. You have a better chance of getting your dog back if the person who finds it can find you. A harness provides better control over your dog/puppy when walking, going to the dog park, to the vet, to the groomer, or just out visiting. Know someone who might like a pom puppy? Since I am looking for caring people to purchase my puppies, I appreciate referrals. If you send someone to me and they buy a puppy, I will pay you $50 after that puppy has been spayed/neutered per contract terms as a “Thank you”. Please feel free to give out my phone number to anyone you think may be a good match for a wonderful puppy. I also give a discount to returning puppy buyers as I usually do not sell littermates to the same owner. Puppy Tips Don’t ever leave your pet unattended in the yard, they could easily escape under the fence, be stolen or killed. Other people’s dogs are not always nice, so take necessary precautions when introducing or passing other dogs. When you get your new family member home everyone will want to pet or hold him/her. Don’t overdo it. The stress of leaving his littermates and adjusting to a change in environment will strain this little guy. Cuddle and play with him/her but also give him/her plenty of rest. (See Hypoglycemia) Never feed your puppy chocolate, grapes, raisins or any spicy/greasy foods. Rawhides are ok, but be sure you are able to supervise and that they are USA made. Keep in mind the size of the puppy when choosing treats and toys. Never give your puppy people food (i.e. milk, meat from the table, bones, onions, etc.). It will most likely cause stomach upset or infection which can be deadly. I recommend you keeping your puppy on the diet it was sent home on, however, should you at some point need to change the food, do it gradually. The puppy’s diet consists of dry food; however, you may offer him 1 tsp cottage cheese or yogurt twice daily to help with diarrhea or the adjustment to the new home. If he is eating the dry food well, other supplements to encourage eating may not be needed. Free choice feeding is not recommended but may be necessary in the beginning. By the time your puppy is 3 months old it should be on a regular feeding schedule of 3 times daily. Offer the puppy whatever it wants to eat for about 15 minutes (usually ¼ cup) or until he loses interest. Then take the food up until the next feeding. He should have a BM within 1 hour of eating, making house training easier. Umbilical cording, or putting a leash on the puppy and tying to your belt loop, may be helpful if you are not able to watch the puppy at all times. This prevents him from sneaking off and eliminating inappropriately and serves as an alternative to crating. Puppy proof your home. Many household plants and yard plants are poisonous to your pet. Become informed of them and keep the puppy safely away from them. Do not leave him unattended in your home, free to roam around. Electric cords, buttons, paper clips, etc. that he might find and chew on or swallow can cause illness or death. Poms need regular brushing and bathing. It is important that you take special care when your puppy is young. He will need his feet and nails trimmed regularly. Getting him started at an early age will help to make this a positive experience as he ages. Your puppy will go through what is called the “puppy uglies” (blow his coat) at about 4-8 months. This is normal and his coat will come back and be beautiful by the time he is a year old. Age appropriate training should begin with gently showing your puppy what is expected of him. He has been litter box trained, so take him to the area you wish him to eliminate in whether it be inside or out. Take him to the same area consistently and give him small rewards and lots of praise when he goes there. If he has an accident somewhere else, pick it up and take it to the appropriate place to show him where it belongs. Never beat your puppy or put his nose in his waste….you will make him scared of YOU, not scared to pee!!! If you do not actually see him going potty in the wrong place, ignore it, as he doesn’t even remember doing it! When leaving him home alone for short periods, leave him in his crate. This will give him a sense of safety and security. As he gets older, he will be able to stay in his crate for longer periods of time without having accidents. The crate should be large enough for your puppy to stand up, turn around, and stretch out when lying down. It should not be large enough for him to sleep at one end and potty at the other. Also water should be available at ALL times, even while the puppy is crated. Taking his water away will not prevent him from urinating. His kidneys are developing and withholding water can affect proper development over time. Hypoglycemia Because of the Pomeranians small size and high-energy requirements, the pom is predisposed to episodes of hypoglycemia or low blood sugar. This is especially a concern in the smaller dogs and puppies and during times of illness or stress, such as a change of homes, traveling or any major change in the poms daily routine. Hypoglycemia can be recognized by a pom suddenly becoming weak, listless and confused or unaware of its surroundings. The pom may be unable to walk without stumbling or may not be able to stand up at all. The gums will appear pale and the eyes will look dazed. As symptoms progress, the pom may go into convulsions and coma followed by death. Hypoglycemia progresses quickly so it is vital that pom owners be familiar with its symptoms. At the first signs of hypoglycemia, you should administer some form of glucose. Nutri-Cal and karo syrup are the most popular form of glucose used by breeders of Pomeranians, but even sugar water can do in a pinch if the other products are not available. If the pom is unconscious, immediately rub the glucose on its gums and under its tongue. Do not take time to call your vet until AFTER administering some form of glucose. Do not administer sugar water if the pom is not conscious as it could choke on the water. The pom should respond quickly to treatment, especially when glucose is administered in the early stages of an attack. Even if your pom appears fine after receiving the glucose, it is important that you contact your vet as complications can occur. After your pom has sufficiently recovered from the attack it is important to offer your pom some high protein food such as beef baby food, banana yogurt baby food, or small pieces of cheese. Hypoglycemia is easily prevented. Simply provide your pom with high quality food and water at all times. It is also important to provide a quiet, out of the way place where your pom can rest. Your pom should eat small amounts of food throughout the day and take frequent rest periods. Watch your pom closely if it has not been eating like it should. Do not change your brand of food abruptly. If a change of food is required, mix the old brand with the new for several days, gradually increasing the amount of the new brand until the switch is made. Taking 5-7 days to switch food will help to prevent diarrhea but promptly treat any signs of loose bowels in the manner recommended by your vet. Do not give your pom too many treats as this could cause it to go off its food. An occasional tidbit will do no harm, but do not make it a habit of feeding people food, or treats. Canned food is not recommended because it can have detrimental effects on the health of the teeth. If you wish to feed a soft food, make sure your pom has regular veterinary dental are and brush its teeth daily and provide plenty of chew toys. Your puppy has been being fed Nutrisource Chicken & Rice Puppy food. It is made in the USA and is available only through certain pet stores or online. You can check their website for stores in your area should you wish to continue feeding this food. It cannot be purchased at a grocery store and I do not recommend grocery store brands for your dog. Never feed a generic brand food or one that does not bear the AAFCO seal of approval. Feeding a lower quality food may result in more frequent bowel movements and often require a higher volume to maintain your dog’s health. You will save money in the overall cost of food and vet care if you feed a good quality food such as Nutro or Science Diet.
